The Supreme Court on Thursday (July 10, 2025) made it clear that it had not passed any written order while refusing to list the petition against the performance of the film ‘Udaipur Files: Kanhaiya Lal Taylor Murder’.
Senior advocate Kapil Sibal, appearing on behalf of accused Mohammad Javed, said that the bench’s comment has created confusion due to ‘let the film release’. After this, this explanation has come from the bench of Justice Sudhanshu Dhulia and Justice Joymalya Bagchi.
Case against the accused is biased
On seeking clarification from Sibal, the bench said that it had made this comment, but no written order was passed and the court had rejected the request for immediate hearing. Sibal said that due to the release of the film on July 11, the case against the accused will be biased.
He told the bench that the High Court was moved in this case, who has asked him to ask for clarification on the order of July 9. He said, “The petition has not been heard and the oral comment of the court has created confusion.”
‘Let the film be released’
Justice Bagchi said that if the film should not be shown, Justice Dhulia said that the court had only said that he was not hearing immediately. He said that there should be no confusion about this. On July 9, the Supreme Court refused to list the petition against the screening of the film immediately and said, “Let the film be released.”
The bench made this comment when the lawyer of an accused in the murder case said that the release of the film would adversely affect the hearing of the case. The lawyer said that the film will be released on July 11 and its producers have released the trailer of the film, which has created apprehension that this will affect the hearing of the case and violate the right to hear the accused.
Eighth accused filed a petition in court
The bench said, ‘Let the film be released. AAP (after the court opens after the summer vacation) mention this petition before the regular bench. The petition was filed on behalf of Mohammad Javed, who is facing trial as the eighth accused in the case. Javed had demanded a ban on the release of the film until the hearing of the case was completed.
The petitioner said that the film looks ‘communally inflammatory’ with its trailer and publicity material and the release of the film at this time is expected to adversely affect the hearing.
