The Supreme Court on Thursday (December 4, 2025) granted interim protection for a week to two petitioners facing demolition of properties in Uttar Pradesh and directed that status quo be maintained by the parties till then.
The bench of Justice Vikram Nath and Justice Sandeep Mehta asked the petitioners to approach the Allahabad High Court for appropriate orders. The petitioners said that partial demolition of their residential or marriage hall premises has already been done by the authorities.
The bench said it was granting interim protection for a week as partial demolition had already taken place. The court said, ‘Considering the above facts, we grant interim protection for a period of one week from today and till then status quo will be maintained by the parties.’
The Supreme Court made it clear that the interim protection given by it will not affect the High Court in considering the petition and hearing the stay petition on its merits. The bench passed this order while hearing a petition requesting the authorities to restrain the authorities from further demolishing the residential or marriage hall structures of the petitioners without following due process of law.
At the commencement of the hearing, the bench asked the counsel appearing for the petitioners as to why they first approached the Supreme Court and not the Allahabad High Court. The lawyer said that the Supreme Court had considered the issue of bulldozer justice.
The bench said, ‘The court has already given a detailed decision. Then approach the High Court and take advantage of that decision. What is this? Why do you have to resort to (Article) 32 every time?’ The bench said, ‘It is not that the Allahabad High Court does not consider the urgency. You have to mention it.
