SIR Vs FIR: Case against Sonia-Rahul before Parliament session, will the opposition support or will Congress be isolated?


The winter session of Parliament will run from Monday (1 December 2025) to 19 December, in which the government is going to introduce 14 important bills. The opposition is preparing to corner the Center on the issue of Special Intensive Revision (SIR) of voter lists in 12 states and union territories, China and the blast near Red Fort. Before the Parliament session, the Economic Offenses Wing (EOW) of Delhi Police has registered a new FIR against Sonia Gandhi and Rahul Gandhi in the National Herald case, due to which politics has heated up.

In which case was the case filed against Rahul and Sonia Gandhi?

Ever since Narendra Modi became the Prime Minister of the country in the 2014 Lok Sabha elections, he has been emphasizing that the identity of Congress is linked to corruption, which reaches up to the Gandhi family. Apart from Rahul and Sonia Gandhi, names of 3 companies and 6 other people are also included in the EOW FIR. All of them are accused of fraudulently acquiring Associated Journals Limited (AJL).

What is the allegation against the Congress leader?

The case is based on allegations that the leaders and their associates conspired to wrongfully gain control of a company, which was earlier linked to the Congress and had assets worth about Rs 2,000 crore. According to the FIR registered on October 3, this acquisition was done through Young Indian. Rahul and Sonia Gandhi hold 76 percent stake in Young Indian.

The ED used powers available under Section 66 (2) of the Prevention of Money Laundering Act (PMLA) to register the police FIR. This section allows the federal agency to share evidence with a law enforcement agency to register a criminal case of money laundering to further the investigation. The FIR will serve to strengthen the ED’s case and charge sheet.

When a case was filed against the Congress high command, the party got angry

The case pertains to the order of the court of the Metropolitan Magistrate of Delhi, which on June 26, 2014 had taken cognizance of a complaint by BJP leader Subramanian Swamy against alleged irregularities in the affairs of National Herald. In the FIR, cognizance has been taken of the allegations made in the letter sent by ED to EOW on September 4.

Congress leader Abhishek Manu Singhvi made a post on X saying, “There is neither new wine, nor new bottle nor new glass.” This is a unique case where neither any money was moved nor any immovable property was transferred, yet a case of money laundering was discovered.” He said that whenever the party wants to raise an issue, such old cases are raised again.

Will Congress support the opposition in Parliament or will it be isolated?

Registration of FIR against Congress Rahul and Sonia Gandhi a day before the start of winter session can have an impact on the party. Now Congress will have to fight this issue also. The court will give its verdict in the Herald case on 16 December 2025. If the verdict puts top Congress leaders in the dock, it will further weaken the fight.

It is expected within the Congress that the workers will change their stance and focus on the Gandhi family, but Rahul Gandhi’s planning was not like this. He also wanted to put Karnataka’s power struggle on the back burner because he did not want attention to be diverted from the December 14 mega rally and SIR. At this time, Congress will need its allies from India Alliance. The question is, will opposition parties like DMK, TMC, RJD, who are also accused of corruption, support and support the Gandhi family in Parliament?
