The Supreme Court has rejected the petition filed in the case of death of children due to cough syrup. The court has done this by raising questions on the seriousness of petitioner lawyer Vishal Tiwari, who has been continuously filing PIL.
The petitioner had demanded an investigation into the arrangements for manufacturing, testing and distribution of medicines under the supervision of a former Supreme Court judge. A demand was also made in the petition to hand over the investigation into the deaths of children to the CBI.
Petitioner’s argument
Vishal Tiwari, appearing before Chief Justice Bhushan Ramakrishna Gavai and Justice K Vinod Chandran, said that this is not the first case of wrong medicines reaching the market. The Supreme Court should take cognizance of the matter. Many children died in this case, but the state governments are blaming each other.
‘State governments are doing their work’
Solicitor General Tushar Mehta, who was present in the court, intervened in the hearing. Mehta said that he is not appearing for any state. He is not even trying to say that the death of children is not a serious matter, but be it Tamil Nadu or Madhya Pradesh, all the states are taking action. There are laws in this regard, action is being taken according to them. People are being arrested. The medicine has been removed from the market.
‘Petition in every case under discussion’
Solicitor General Tushar Mehta drew the court’s attention to the seriousness of petitioner Vishal Tiwari. He said that whatever topic is being discussed, this petitioner immediately files a PIL after seeing it in the media. On this the Chief Justice asked Vishal Tiwari how many PILs he had filed. Tiwari said, ‘Maybe 8 or 10.’ On hearing this, the Chief Justice said, ‘Dismissed’ and rejected the petition.
