Case of alleged defamation of PM Modi, Supreme Court indicated to settle the case registered against Congress MP Shashi Tharoor


The Supreme Court has indicated to settle the case filed against Congress leader Shashi Tharoor for defaming the Prime Minister. The bench of Justice MM Sundaresh and Justice Satish Chandra Sharma has directed to put the case up for hearing in February. This case is pending in Delhi’s Rouse Avenue Court since 2018.

What is the matter?
In 2018, Shashi Tharoor had called PM Modi a scorpion sitting on Shivling. BJP leader Rajiv Babbar had filed a defamation case regarding this. In 2019, the lower court had granted bail to Tharoor on a personal bond of Rs 20,000. Tharoor went to Delhi High Court to get the case quashed. But he did not get relief. Last year he came to the Supreme Court. In the hearing held on September 10, 2024, the Supreme Court had put an interim stay on the action of the lower court.

Tharoor’s argument
Shashi Tharoor argues that he did not say anything from his side. Just repeated what was published in a magazine. The lower court should not have taken cognizance of the case because the complainant Rajeev Babbar is not directly affected in the case. His petition should not have been accepted.

What did the Supreme Court say?
In the earlier hearing, the Supreme Court had advised Babbar to close this case. The court had said, ‘People should not be so sensitive in public life. Many people say many things. Even we judges don’t pay attention to them. Now the Supreme Court has said that it will settle this matter.
