Delhi High Court said in clear words that beverages being sold under the name ORS are a threat to public health and the ban on it will continue. The court clarified that it will not interfere in the order of the Food Safety and Standards Authority of India, because this matter is directly related to the health of the people.
The Food Safety and Standards Authority of India had recently issued an order saying that no company is allowed to use the word ORS in its drinks or energy beverages unless the product is a genuine oral rehydration solution as per the standards set by the World Health Organization. FSSAI had called it misleading and a violation of the law.
The company opposed the FSSAI order in the court.
Actually, this matter is related to Rebalanz VITORS, a product of Dr. Reddy’s Laboratories. The company had challenged FSSAI’s orders of October 14 and 15 in the High Court. During the hearing, the company said that it is no longer making new batches with this name and is ready to change the name.
However, the company demanded that the products which are already present in the market should be allowed to be sold. Additional Solicitor General Chetan Sharma, on behalf of FSSAI, argued in the court that such products mislead the common people and can become a health hazard. He said that this ban is completely justified.
Delhi High Court declared FSSAI’s order correct
In Delhi High Court, Justice Sachin Dutta also agreed in favor of FSSAI and said that this is a serious health matter, no compromise can be made on this, this ban will continue. The court directed the company that it can present its case before FSSAI regarding change of name and sale of remaining stock, but in any case the court will not give permission. Delhi High Court said that public health is paramount and allowing such products to run in the market is not acceptable at any cost.
