On 13 May 2023, communal riots erupted due to an objectionable social media post about Prophet Muhammad in Akola city of Maharashtra. 17 -year -old petitioner Mohammad Afzal Mohammad Sharif claims that he was seriously injured in the riots. The police took his statement in the hospital but did not register an FIR.

The petitioner claims that he saw four people hitting a person with a sword and iron pipe on the Rajeshwar bridge. Later this person was identified as Vilas Mahadevrao Gaikwad. Gaikwad died in this attack. The police registered an FIR in the case, but remained inactive in his case. If the police had accepted him as a victim, then false and concoction of the police would have been exposed in the murder case.

Mohammad Afzal had earlier approached the Bombay High Court, but his plea was rejected by the High Court. The High Court had expressed suspicion that it was doing so to help the accused of killing Vilas Gaikwad. The High Court also said that if the police was not investigating the complaint of the petitioner, it should have received an FIR order from the magistrate under Section 156 (3) of the CRPC.
