Siddaramaiah’s legislation challenged in the Supreme Court, who raised the demand to cancel it?


The Supreme Court has issued a notice on Monday (December 8, 2025) on the petition challenging the election of Karnataka Chief Minister Siddaramaiah. The petitioner named KM Shankara alleges that in 2023, Siddaramaiah had won the election by adopting corrupt means, hence, his election as MLA from Varuna seat of Mysore should be cancelled. Earlier, the Karnataka High Court had rejected the petition saying it was filed without proper facts.

This matter was placed before the bench of Justice Vikram Nath and Justice Sandeep Mehta on Monday, on which the bench has issued a notice and sought reply from Siddaramaiah. The petitioner is a voter of Shankara Varuna seat. By filing a petition in the Karnataka High Court, he had alleged that the Congress Party had made five such election promises in its manifesto for the 2023 Karnataka Assembly elections, which are tantamount to bribery and corrupt practices under the Representation of the People Act. The petitioner alleged that Siddaramaiah’s consent was also included in the manifesto, hence it applies to him also.

The petitioner demands that Siddaramaiah’s legislature should be canceled and he should not be allowed to contest elections for six years. When he filed this petition in the High Court in April, Justice Sunil Dutt Yadav had rejected the petition saying that election promises cannot be corrupt practices. The judge had also criticized the careless manner in which the petition was filed.

It was observed that there was a discrepancy in the paragraphs of the affidavit and the petition filed for verification and the name of the Chief Secretary of the state was also written incorrectly. On this, the court had said that these things indicate a very careless approach while filing the petition.
