Supreme court reached the case of death of children from Kapha Syrup, PIL filed this demand from court


In Madhya Pradesh and Rajasthan, a public interest litigation has been filed in the Supreme Court in view of the death of children due to alleged consumption of poisonous phlegm syrup. The PIL filed by advocate Vishal Tiwari requested an inquiry under the supervision of these incidents under the supervision of the court.

Along with this, under the leadership of a retired judge of the Supreme Court, the formation of the National Judicial Commission or Expert Committee has also been requested. The PIL requested that all pending FIRs and investigations related to the death of children allegedly caused by poisonous phlegm syrup in various states should be transferred to the Central Bureau of Investigation (CBI). It has been requested to investigate under the supervision of a retired judge of the Supreme Court to ensure fairness and uniformity.

What is the plea given in the petition?
The petition has argued that the accountability has also been divided due to different state-level investigations, which is repeatedly lapse and dangerous ‘formulation’ (medicine) is reaching the market. This petition has come amid reports of death of many children from Madhya Pradesh and Rajasthan allegedly drinking a special type of phlegm syrup. The petition requested the court to direct the central government to constitute a judicial or expert body at the national level so that the regulatory deficiencies can be identified due to which substandard medicines reached the market.

In this, the court has also been requested that all suspected products should be made mandatory through NABL-recognized laboratories before allowing any sales or exports further.

Children died due to phlegm syrup in Madhya Pradesh and Rajasthan
So far, 19 children have died due to drinking phlegm syrup in Madhya Pradesh and 4 children in Rajasthan. After this incident, Madhya Pradesh, Rajasthan, Kerala, Tamil Nadu and Punjab have immediately banned the sale and use of this syrup. The Drug Control Department of Tamil Nadu has issued a show cause notice to the company Srison Pharmaceuticals based on Kanchipuram, which makes syrup. The government has sought a reply from the company within five days.
