The Supreme Court has refused to cancel the bail of Kanhaiya Lal murder accused Mohammad Javed. Kanhaiya Lal’s son Yash Teli and the National Investigation Agency (NIA) challenged Javed’s bail. He said that the High Court has ignored the important evidence against the accused.
In June 2022, Kanhaiya Lal, who did a tailor work in Udaipur, was brutally murdered by cutting his throat. In those days, there was a lot of controversy about a statement of BJP leader Nupur Sharma about Prophet Mohammed. Kanhaiyalal shared a post supporting Nupur on social media, so Mohammad Riyaz and Mohammad Gaus killed him. Both also broadcast the video of it on social media.
It is alleged that many more people supported Riyaz and Gaus in murder. One of them is also Javed. Javed is accused of reconnaissance of Kanhaiya Lal to help the killers. He informed the killers about the present at Kanhaiya’s shop. On September 5, 2024, the Rajasthan High Court granted bail to Javed, saying that there is not enough evidence of his role in the case.
Now Supreme Court Justice MM Sundresh and Justice Satish Chandra Sharma have refused to change the order of the High Court. The judges said that the age of the accused was low at the time of the murder. He was 19 years old. There are a total of 166 witnesses in the ongoing trial in the lower court. So far, only 8 testimony has been done. In such a situation, it will take time to complete the case, so it will not be right to cancel the bail of the accused.
NIA also mentioned the comments made by the High Court while giving bail to Javed. The NIA lawyer said that this will affect the case. On this, the Supreme Court said that the lower court should do its work without being affected by those comments. The Supreme Court also made it clear that the bail received by Javed will not affect the bail petitions of the remaining accused. The court should take a separate decision on them.
