‘Supreme Court reprimanded Goswami side over the Banke Bihari temple dispute

During the hearing of the management dispute related to the historic Shri Banke Bihari temple in Vrindavan, the Supreme Court reprimanded the lawyers of the Goswami family. During the hearing, the three-member bench warned the lawyers appearing by the Goswami family in a strict tone that the same issue would not be tolerated again and again. The three -member bench includes Chief Justice BR Gawai, Satish Chandra Sharma and K Vinod Chandran.

Hearing the case, a three-member bench warned the lawyers of the Goswami side that the same issue repeatedly is misused by the court process and contempt action will be taken if this happens in future. Senior Advocate Naveen Pahwa and K.K. Natarajan made it clear that the Goswami side had already tried to move the case to the second bench, while the matter was already listed in the bench of Justice Satish Chandra Sharma.

If such a situation arises then contempt proceedings: Court
When an attempt was made to raise the same issue once again by the Goswami side, which the court had already rejected, the bench expressed a clear disagreement and said that raising the same subject repeatedly is not in accordance with the judicial process. The bench said that this type of repetition is not appropriate and it should be stopped. The court said that you cannot do this. The bench also warned that if such a situation happened again and deliberately presented to another bench, contempt proceedings against the concerned lawyer can be considered.

This reaction of the court made the lawyers of Goswami side somewhat uncomfortable. The Supreme Court reiterated that it would not accept manipulation in procedural misuse or court process and if any such effort is made in future, serious action will be taken. The Chief Justice directed to start the contempt process against Kapil Sibal’s junior lawyer Shivansh Pandya, but Justice Satish Chandra Sharma did not take this action forward by showing greatness.

What is the matter?

Actually, this case is related to the famous Banke Vihari temple in Vrindavan. Where there has been a dispute between Goswami family and Uttar Pradesh government over the rights and management. On 27 July, Goswamis filed a petition against the Supreme Court on behalf of the temple management committee against the government ordinance of the temple management. Significantly, this committee was formed a few days ago.
