After the Supreme Court granted bail to 5 accused in the 2020 Delhi riots conspiracy case, another accused has filed a fresh bail petition. The accused argues that he too faces the same charges as the other accused and is demanding equal justice.
The bail plea has been filed by Salim Malik alias Munna, one of the 11 alleged organizers and speakers of the anti-CAA/NRC meeting. The court has framed charges against him under criminal conspiracy. In the petition filed before Additional Sessions Judge Sameer Bajpai, it has been argued that the Supreme Court had on Monday granted bail to another accused accused on similar charges and his position in this case is also similar.
What was said in the petition
The petition said the case against Malik only presents him as a local activist associated with the meetings held at the Chand Bagh protest site, similar to co-accused Salim Khan, who was granted bail by the Supreme Court on January 5. The alleged organizers were Mohammad Salim Khan, Salim Malik, Mohammad Jalaluddin alias Guddu Bhai, Shahnawaz, Furkan, Mohammad Ayub, Mohammad Yunus, Athar Khan, Tabassum, Mohammad Ayaz and his brother Khalid.
Hearing will be held on January 8
The court has fixed January 8 as the date of hearing on Malik’s bail plea. Malik is accused of setting fire to a car showroom in Bhajanpura area of north-east Delhi on February 24, 2020. It was argued that the Supreme Court in its bail order had said that the conduct of the accused who have been granted bail is determined primarily by the instructions allegedly issued by others.
Petition filed on the basis of these arguments
The bail plea further said that it is appealed that the situation of the applicant (Salim Malik) is also similar, as there is no evidence on record against the applicant to show that the applicant was involved in hatching a larger conspiracy. Nor is there any evidence to show that the applicant created a situation which could have increased the tension.
